Our services may change as TCCA develops.

2. Eligibility

You must be at least 18 years old to create a profile, apply for opportunities, purchase services or enter into commercial arrangements through TCCA unless we expressly permit otherwise and appropriate parental or guardian consent is obtained.

By using our services, you confirm that the information you provide is accurate and that you have the legal capacity to agree to these Terms.

3. Creator Profiles and Applications

Creators may be invited to register a profile, join our creator network, apply for opportunities or provide information about themselves and their content.

Information requested may include your:

  • name and contact details;
  • location;
  • social media accounts and handles;
  • creator category or niche;
  • portfolio or examples of work;
  • photographs, videos or other content;
  • audience information and statistics;
  • experience, interests and availability;
  • rates or commercial preferences; and
  • other information relevant to creator opportunities.

You are responsible for ensuring the information you provide is accurate, current and does not infringe the rights of another person.

Submitting a creator profile or application does not guarantee acceptance into the TCCA creator network, access to campaigns, paid work, brand collaborations or any particular commercial opportunity.

TCCA may determine which creators are suitable for particular opportunities based on the requirements of the relevant campaign, client or brand.

4. Creator Network and Brand Opportunities

TCCA may use information submitted by creators to identify creators who may be suitable for campaigns, collaborations, events, projects or other opportunities.

Where appropriate, information that you have authorised for this purpose may be presented or shared with prospective brands, businesses, agencies or partners considering creators for an opportunity.

We will handle personal information in accordance with our Privacy Policy.

Unless expressly agreed otherwise, TCCA does not guarantee:

  • that a creator will receive work;
  • the number or frequency of opportunities;
  • that a brand will select a particular creator;
  • any level of earnings or income;
  • audience growth;
  • engagement, reach or social media performance;
  • ongoing relationships between creators and brands; or
  • the outcome of any campaign or collaboration.

5. No Employment or Agency Relationship

Registration with TCCA does not create an employment relationship between you and TCCA.

Unless expressly agreed in writing for a specific engagement, creators are not employees, partners, representatives or agents of TCCA.

Where creators undertake paid work, the specific commercial relationship and responsibilities may be governed by separate campaign, contractor, creator or brand terms.

6. Brands and Businesses

Brands and businesses may contact TCCA regarding creator campaigns, partnerships, content creation, marketing services and other commercial opportunities.

Information provided by brands may be used to assess the enquiry, develop recommendations, identify appropriate creators and communicate regarding potential projects.

Submitting an enquiry does not create a binding commercial agreement.

Any campaign, project, agency engagement or paid service may be subject to a separate proposal, scope of work, campaign agreement or service agreement.

7. Memberships and Communities

TCCA may provide free or paid memberships, online communities, groups or networking spaces.

Members must behave respectfully and must not:

  • harass, threaten or abuse other members;
  • unlawfully discriminate against another person;
  • spam or repeatedly solicit members;
  • scrape or harvest member information;
  • use information obtained through TCCA for unauthorised marketing;
  • impersonate another person or business;
  • upload unlawful or infringing material; or
  • interfere with the operation or security of our platforms.

We may moderate or remove content and may suspend or terminate access where reasonably necessary to protect our members, business or community.

8. Creator and User Content

Where you upload or submit photographs, videos, portfolio material, testimonials, social media content or other material to TCCA, you retain ownership of your content unless otherwise agreed.

You grant TCCA a non-exclusive licence to store, reproduce and display that content to the extent reasonably necessary to:

  • operate your creator profile;
  • administer the creator network;
  • assess applications;
  • present your profile to relevant prospective brands or partners where authorised;
  • provide the services you have requested; and
  • operate TCCA.

We will seek additional permission where we wish to use creator content for unrelated promotional or advertising purposes unless that permission has already been clearly obtained.

You confirm that you own or have permission to provide the material you submit.

9. Intellectual Property

Unless otherwise stated, TCCA owns or licenses the intellectual property contained on our website and within our products, training, resources, branding, graphics, templates and materials.

You may use purchased or supplied materials for their intended personal or business purpose.

You must not reproduce, resell, redistribute, publish, commercially exploit or claim ownership of our intellectual property without permission.

10. Paid Products, Services and Memberships

Prices will be displayed in Australian dollars unless otherwise stated.

Additional terms, payment arrangements, minimum periods, cancellation provisions or renewal terms may apply to particular products, memberships or services and will be disclosed before purchase or agreement.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.

11. Educational and Business Information

Information, resources, training and content provided by TCCA are general in nature.

Results in content creation, social media, marketing and business vary significantly.

Examples, case studies, creator opportunities and discussions of income or commercial outcomes are not guarantees that you will achieve the same results.

You remain responsible for your own business, financial, tax, legal and commercial decisions and should obtain professional advice where appropriate.

12. Third-Party Platforms

TCCA may link to or use third-party services including social media platforms, payment providers, email providers, analytics platforms, community platforms and other technology providers.

Your use of those services may also be subject to their own terms and privacy policies.

TCCA is not responsible for the operation, availability or conduct of third-party platforms outside our reasonable control.

13. Website Availability

We aim to keep our website and services available and accurate but do not guarantee uninterrupted or error-free access.

We may update, modify, suspend or discontinue parts of the website or services where reasonably required for operational, commercial, legal or security reasons.

14. Limitation of Liability

To the maximum extent permitted by law, TCCA is not liable for indirect or consequential loss arising from your use of our website or services.

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including rights and remedies that cannot be excluded under the Australian Consumer Law.

15. Privacy

Personal information is handled in accordance with our Privacy Policy.

By providing personal information to us, you acknowledge that it will be handled for the purposes explained at the time of collection and in our Privacy Policy.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes to our services, business or legal requirements.

The current version will be published on our website with the date it was last updated.

Changes will not retrospectively remove rights that you have under applicable law.

17. Governing Law

These Terms are governed by the laws of Western Australia and applicable Commonwealth laws of Australia.

You and TCCA submit to the jurisdiction of the courts of Western Australia and any courts entitled to hear appeals from those courts.
